The Advantages of Chapter 7 Bankruptcy

In Chapter 7 bankruptcy, which is sometimes called "straight bankruptcy," most of your debt, including credit card debt, medical bills and past-due mortgage payments, can be wiped away. Some obligations, such as student loans, spousal and child support, and most tax debts are generally not eligible for discharge in bankruptcy. Even if you have those types of debt, however, getting rid of your other debt can make them affordable.

Chapter 7 protection is essentially designed for people who lack the means to pay off consumer debt. In order to qualify for Chapter 7 bankruptcy protection, you must pass a "means test," which considers your disposable income and your level of indebtedness.

It is a fairly simple calculation. If the income for your family of 4 is less than $32,756, for example, you would qualify for Chapter 7. If your disposable income is high in relation to your debt, you may not qualify for Chapter 7 but we can still consider filing for Chapter 13.
