What are Alabama’s Felony Classifications?

In Alabama, as in most other states, felony crimes are divided by classification, including Class A, Class B, and Class C felonies. Depending on the specific crime and other circumstances, you may be facing severe consequences. Any felony has a serious and lasting impact on your life, so you should make sure you have an attorney to provide a strong defense.

Our law firm represents clients accused of all types of felonies, including:

  • Class A – Crimes considered Class A felonies include murder, rape, kidnapping in the first degree, burglary, or trafficking heroin or cocaine. This type of felony is punishable by life imprisonment or a definite term ranging from 10 to 99 years and a fine of up to $60,000.

  • Class B – This category includes criminal offenses such as domestic violence in the first degree, burglary in the first degree, vehicular homicide, and discharge of a gun in an occupied building or vehicle. This type of felony is punishable by a prison sentence between two and 20 years, and a fine of up to $30,000.

  • Class C – Offenses in this category include forgery, identity theft, fraud, theft of property, possession of a forged instrument, and shoplifting. This type of felony is punishable by a prison sentence between 366 days and 10 years, and a fine of up to $15,000.

  • Class D – This category includes crimes such as drug possession and theft of property worth between over $500 and less than $1,500. This type of felony is punishable by a prison sentence between 366 days and five years, and a fine of up to $7,500.

If a gun or any other deadly weapon is used during the commission of a felony or the felony is a sex crime involving a child, the minimum sentence is 10 years of Class B or C felonies and 20 years for Class A felonies. When it comes to a felony hate crime, the minimum sentence is 18 months for Class D felonies, two years for Class C felonies, 10 years for Class B felonies, and 15 years for Class A felonies.

Keep in mind, some felonies may result in a split sentence, meaning part of the term is spent behind bars while the rest is spent on probation. While a judge may order a split sentence for Class A, B, and C felonies, a defendant must receive a split sentence for Class C and D felonies, unless they have been sentenced to pretrial diversion, convicted of a sex crime, or have previously been convicted of a Class A, B, or C felony.

If you are facing felony charges, hiring an experienced criminal defense lawyer should be a top priority. Attorney Joseph Ingram can defend your rights throughout the process and prepare and present a solid defense in court.
